Default Bail (Statutory Bail)

Bail granted as a right when police fail to file a chargesheet within the statutory deadline.

Full Definition

Default bail is an indefeasible right arising when the chargesheet is not filed within 60 days (magistrate-triable) or 90 days (sessions-triable) of arrest. The right is lost if the accused does not apply before the chargesheet is filed.

In Indian Law

Section 167(2) CrPC (Section 187(2) BNSS). In Uday Mohanlal Acharya v. State of Maharashtra (2001), the Supreme Court held the right is indefeasible.
