Regular Bail

Post-arrest bail to release the accused from custody pending trial.

Full Definition

Regular bail is granted after arrest. For bailable offences it is a right; for non-bailable offences discretionary. Courts apply the triple test: flight risk, evidence tampering risk, repetition risk.

Sections 437 and 439 CrPC (Sections 480 and 483 BNSS). In Arnesh Kumar v. State of Bihar (2014), the Supreme Court issued guidelines preventing unnecessary arrest.
