Criminal Conspiracy
An agreement between two or more persons to do an illegal act or a legal act by illegal means.
Full Definition
Criminal conspiracy (IPC Section 120A) is complete at the stage of agreement. The agreement is the actus reus; intent to pursue the criminal objective is the mens rea. All conspirators are equally liable for acts in furtherance.
In Indian Law
IPC Sections 120A-120B (BNS Sections 61-62). In State (NCT of Delhi) v. Navjot Sandhu (2005), the Supreme Court held mere knowledge without agreement is insufficient.
