Common Intention

A shared criminal purpose making each participant equally liable for acts done in furtherance of that purpose.

Full Definition

Section 34 IPC: when two or more persons commit a criminal act in furtherance of a common intention, each is as liable as if they had acted alone. Requires: pre-arranged plan, active participation, acts in furtherance.

In Indian Law

IPC Section 34 (BNS Section 3(5)). In Mahbub Shah v. Emperor (1945), the court distinguished Section 34 (direct participation required) from Section 149 (mere membership of unlawful assembly sufficient).
