Mahatma Gandhi National Rural Employment Guarantee Scheme

MGNREGS (Mahatma Gandhi National Rural Employment Guarantee Scheme) is enshrined in law as the Mahatma Gandhi National Rural Employment Guarantee Act 2005 — making it one of India's few schemes where employment is a LEGAL RIGHT, not just a programme. Any rural household can demand work and must receive it within 15 days — or the Government must pay an unemployment allowance.

**The Legal Right Framework:**

The Act creates a time-bound, legally enforceable entitlement. If work is not provided within 15 days of a written demand, the state government must pay an unemployment allowance: 1/4 of wage rate for the first 30 days of unemployment, and 1/2 of wage rate thereafter. This is fundamentally different from all other government employment schemes — it is a right, not a discretionary benefit.

**Who is covered?** Any adult (18+) member of a rural household can demand work. There is NO income limit, no caste restriction, no gender restriction. A wealthy landowner's adult son living in a village can technically demand MGNREGS work (though in practice, the scheme serves the rural poor). Anyone with a Job Card can demand work at any time during the financial year.

**What work is done?** Only unskilled manual work: road construction, canal desilting, water harvesting structures (check dams, farm ponds), land development, afforestation, rural connectivity, and rural infrastructure. No skilled or semi-skilled work. The work site must be within 5 km of the worker's residence — if beyond 5 km, 10% extra wages plus transport allowance are payable.

**Wage Payment:** Wages are paid directly to the worker's Aadhaar-linked bank or post office account within 7–15 days of work completion. Delayed payment beyond 15 days triggers a compensation payment to the worker (0.05% per day of delayed wages).

**Women's Participation:** By law, at least 1/3 of MGNREGS workers must be women. In many states, women constitute 55–65% of the workforce.

**Wage Rates:** MGNREGS wage rates are set by the Central Government annually (revised April 1 each year) based on the Consumer Price Index for Agricultural Labourers (CPI-AL). Rates vary by state — ranging from ₹228/day (Chhattisgarh, Bihar) to ₹374/day (Haryana) in 2024-25.

**COVID-19 Impact:** MGNREGS was a critical safety net during COVID-19 — demand surged as urban migrant workers returned to villages. The scheme generated a record 389 crore person-days in 2020-21.

**Convergence:** MGNREGS work converges with PMAY-G (90/95 days of construction labour), rural roads (PMGSY), farm ponds under PMKSY, and watershed development projects.
