The court exercises discretion based on: nature and gravity of offence, flight risk, evidence-tampering risk, danger to community, and prior record. Murder, rape, robbery, dacoity are non-bailable.
In Indian Law
Section 437 CrPC (Section 480 BNSS). For NDPS (Section 37) and PMLA (Section 45) offences, twin conditions must be satisfied before bail.
