In a bailable offence, bail is a matter of right � police or court must release the person on bail. There is no discretion to refuse. Bailable offences are generally less serious.

In Indian Law

Section 436 CrPC (Section 478 BNSS). In Rasiklal v. Kishore Khanchand Wadhwani (2009), the Supreme Court held the right is absolute.
