Injunction

A court order requiring a party to do (mandatory) or refrain from doing (prohibitory) a specific act.

Full Definition

Types: (1) temporary injunction � lasts until further order; (2) permanent injunction � granted at case conclusion; (3) ad interim injunction � ex parte, for emergencies. Tests: prima facie case, balance of convenience, irreparable harm.

In Indian Law

Order XXXIX CPC and Specific Relief Act 1963 (Sections 36-42). The three-pronged test was affirmed in Dalpat Kumar v. Prahlad Singh (1991). In IP and trademark cases, injunctions are the primary remedy.
