Full Definition

Ex parte (Latin: 'from one side') describes a judicial proceeding or order at the instance of one party only, without the other party being present. Courts grant ex parte interim orders in emergencies (imminent irreparable harm), followed by notice to the other side to show cause.

In Indian Law

Order XXXIX Rule 3 CPC allows ex parte ad interim injunctions. Section 87 CrPC / Section 303 BNSS allows courts to proceed ex parte when an accused evades appearance. The Supreme Court in Morgan Stanley Mutual Fund v. Kartick Das (1994) laid guidelines for ex parte injunctions.
