A witness with specialised knowledge who gives opinion evidence on technical matters.
Full Definition
An expert witness gives opinion evidence on matters within their expertise � science, foreign law, handwriting, fingerprints, DNA. Expert evidence assists but does not bind the court.
In Indian Law
Section 45 Indian Evidence Act (Section 39 BSA 2023). In State of HP v. Jai Lal (1999), the Supreme Court held expert evidence alone is not determinative � it must be tested against other evidence.
