Legal Text

Whoever wilfully disobeys any direction lawfully given by any person or authority empowered under this Act to give such direction, or obstructs any such person or authority in the discharge of his or its functions under this Act, shall be punishable with fine which may extend to two thousand rupees, or with imprisonment for a term which may extend to six months.

Section 179 creates a standalone offence for defying traffic authorities — going beyond mere traffic sign violation (Section 119) to cover direct disobedience of lawful orders given by any person empowered under the MVA. This includes: refusing to stop when signalled by a uniformed traffic officer (Section 131/179); obstructing a Motor Vehicles Inspector conducting a fitness check; refusing to submit to a breath analyser test (though specific provisions in Section 185 are more commonly invoked); and obstructing a police officer who is seizing a vehicle. The 2019 Amendment increased the penalty significantly — from ₹500 to ₹2,000 — and added the possibility of imprisonment for persistent or egregious non-compliance. The non-compoundable nature means this cannot be settled at the roadside — a court appearance is required, making it a significant deterrent.
