Section 177
General Penalty for Offences
Offences, Penalties and Procedure
Fine: ₹500 / ₹1,500Compoundable: YesEndorsement: No
BARE ACT PROVISION
Legal Text
Whoever contravenes any provision of this Act or of any rule, regulation or notification made thereunder shall, if no penalty is provided for the offence be punishable for the first offence with a fine which may extend to five hundred rupees, and for any subsequent offence with fine which may extend to one thousand and five hundred rupees.
Simplified Explanation
Section 177 is the catch-all penalty provision of the MVA — the default fine for any violation of the Act or its rules that does not have a specific penalty prescribed elsewhere. It operates as the minimum floor of the penalty structure: ₹500 for first offence, ₹1,500 for subsequent. Most minor traffic violations — failure to dim headlights, improper road position, not using indicators, failing to display required documents (Section 130), parking violations (Section 117), ignoring minor traffic signs — attract this general penalty when no specific provision applies. The 2019 Amendment increased the general penalty from ₹100 to ₹500 (a 5x increase) — a deliberate policy signal that even minor violations carry meaningful consequences. Section 177A was added to specifically cover violation of road regulations prescribed under this Act — including provisions relating to golden hour, good samaritan protections, and other new 2019 mechanisms.
Historical Context
The ₹100 general penalty that preceded the 2019 Amendment was widely regarded as laughably inadequate — less than a tea and samosa at a roadside stall. The 5x increase to ₹500 still represents the lower end of meaningful deterrence but is a clear policy improvement.Critical Changes
Penalty increased from ₹100 to ₹500 (first) and ₹500 to ₹1,500 (subsequent) — 2019 Amendment.
Section 177A added — violation of road regulations: ₹500.
Practical Scenarios
"Failing to use indicators before turning — Section 118 violation, ₹500 general penalty."
"Not displaying required reflectors on a goods vehicle — Section 177 violation."
"Parking in a no-parking zone — Section 117 violation, ₹500 fine."
Common Queries
Under Section 177, the minimum fine for any MVA violation without a specific penalty is ₹500 for a first offence and ₹1,500 for subsequent offences (post-2019 Amendment).
