Section 128
Safety Measures for Drivers and Pillion Riders
Control of Traffic
Fine: ₹1,000Compoundable: YesEndorsement: Yes (helmet violation)
BARE ACT PROVISION
Legal Text
The driver and every occupant of a motor vehicle shall wear a safety belt, if provided in the vehicle. The driver of a two-wheeler and every pillion rider shall wear a protective helmet. The State Government may prescribe the standards for such helmets.
Simplified Explanation
Section 128 (read with Section 129 for helmets) establishes the mandatory safety equipment requirements for road users. Seat belts: mandatory for the driver and all passengers in any vehicle with seat belts installed. The 2019 Amendment extended this to rear seat passengers — previously often unenforced. Section 194B sets the penalty at ₹1,000 for no seat belt. Studies show seat belts reduce fatality risk in frontal crashes by 60%. Helmets: mandatory for all riders and pillion passengers on two-wheelers. Section 129 sets the fine at ₹1,000 plus suspension of driving licence for 3 months for repeat offenders. The helmet must meet ISI (IS 4151) or BIS standards — non-standard 'fashion helmets' technically do not comply. India has the world's highest two-wheeler fatality rate, and helmet use — though legally mandatory since 1988 — remains around 50% nationally with significant rural-urban variation.
Historical Context
India's seat belt and helmet laws have been on the books since 1988 but enforcement has been inconsistent and penalties were historically low. The 2019 Amendment's increased penalties and extension of seat belt requirements to rear passengers represents a significant shift. Studies indicate that consistent enforcement correlates with dramatic reduction in fatalities.Critical Changes
Seat belt mandatory for ALL occupants including rear seat passengers — 2019 Amendment.
Penalty for no seat belt: ₹1,000 (up from ₹100).
Penalty for no helmet: ₹1,000 + 3-month licence suspension for repeat offence.
ISI/BIS-compliant helmet required — non-standard helmets do not satisfy the legal requirement.
Practical Scenarios
"A car driver not wearing a seat belt — ₹1,000 fine under Section 128/194B."
"A rear-seat passenger without a seat belt — ₹1,000 fine (post-2019 Amendment)."
"A motorcycle rider without a helmet — ₹1,000 fine + 3-month licence suspension for second offence."
"A scooter pillion rider without a helmet — ₹1,000 fine."
Common Queries
Yes — following the 2019 Amendment, seat belts are mandatory for all occupants of a vehicle including rear seat passengers where seat belts are provided. The penalty for not wearing a seat belt is ₹1,000 under Section 194B.
The fine for not wearing a helmet is ₹1,000 under Section 129. For a second or subsequent offence, the driving licence may be suspended for 3 months.
Technically no — the law requires helmets meeting IS 4151 (BIS/ISI) standards, which specify minimum protection including chin strap and impact absorption. Many 'fashion helmets' sold in India do not meet these standards. However, enforcement typically focuses on helmet presence rather than standard certification.
