Charge
The formal written accusation stating the specific offence(s) the accused is alleged to have committed.
Full Definition
A charge specifies the offence, relevant section, time, place, and manner. Read and explained to the accused before trial. A defective charge does not vitiate trial unless the accused is prejudiced. The court can add or amend charges before judgment.
In Indian Law
Sections 211-224 CrPC (Sections 250-263 BNSS). Section 228 CrPC: if the Sessions Judge finds sufficient ground, charges are framed. In Hardeep Singh v. State of Punjab (2014), the Supreme Court explained the purpose of charges � ensuring accused knows the case they must meet.
