Punishment for Using Child for Pornographic Purposes

Whoever, uses a child or children for pornographic purposes shall be punished with imprisonment of either description which shall not be less than five years and shall also be liable to fine and in the event of second or subsequent conviction with imprisonment of either description for a term which shall not be less than seven years and also be liable to fine. (1) If the person using the child for pornographic purposes commits an offence referred to in section 3, by directly participating in pornographic acts, he shall also be punished with imprisonment of either description for a term which shall not be less than ten years but which may extend to imprisonment for life. (2) If the person using the child for pornographic purposes commits an offence referred to in section 5, by directly participating in pornographic acts, he shall also be punished with imprisonment for life and also be liable for fine, or with death. (3) If the person using the child for pornographic purposes commits an offence referred to in section 7 by directly participating in pornographic acts, he shall also be punished with imprisonment of either description for a term which shall not be less than six years but which may extend to eight years. (4) If the person using the child for pornographic purposes commits an offence referred to in section 9 by directly participating in pornographic acts, he shall also be punished with imprisonment of either description for a term which shall not be less than eight years but which may extend to ten years.

Legal Commentary

Section 14 creates a graduated punishment structure for child pornography offences — scaling from 5 years for standalone pornographic use up to life imprisonment or death when the accused also directly participated in committing assault against the child. **The five sentencing tiers under Section 14:** 1. *Standalone Section 13 offence* (no assault): Minimum 5 years, maximum 7 years. Second conviction: minimum 7 years. 2. *Section 13 + Section 3 penetrative assault* (Section 14(1)): Minimum 10 years to life. The accused who films himself assaulting a child faces a dramatically higher sentence. 3. *Section 13 + Section 5 aggravated penetrative assault* (Section 14(2)): Life imprisonment or death. This is the most severe POCSO punishment scenario. 4. *Section 13 + Section 7 sexual assault* (Section 14(3)): Minimum 6 years, maximum 8 years. 5. *Section 13 + Section 9 aggravated sexual assault* (Section 14(4)): Minimum 8 years, maximum 10 years. **'Directly participating':** The enhanced punishment under Sections 14(1)–(4) requires the accused to have 'directly participated' in the pornographic acts — meaning they personally committed the assault, not merely filmed another person's assault. A person who only films (without participating in the assault) faces the standalone Section 14 sentence; one who both assaults and films faces the combined sentence. **Death penalty (Section 14(2)):** When the accused participates in an aggravated penetrative sexual assault (Section 5) AND uses the child for pornographic purposes, the court can impose death — making this one of the few POCSO scenarios where capital punishment is specifically provided.

Questions & Answers

For a standalone child pornography offence (Section 13 without any underlying assault): minimum 5 years. If the accused also directly participated in penetrative sexual assault (Section 3): minimum 10 years to life. If combined with aggravated penetrative assault (Section 5): life or death.
'Directly participating' means the accused personally committed the sexual assault (Section 3, 5, 7, or 9) while also using the child for pornographic purposes.
