BARE ACT PROVISION
Legal Text
A person who holds a driving licence issued under this Act shall be competent to drive a motor vehicle in any part of India. The Central Government may grant authorisation to persons holding driving licences issued by competent authorities in any country outside India to drive motor vehicles in India for a period not exceeding twelve months.
Simplified Explanation
Section 13 establishes the framework for foreign nationals and holders of international driving licences to drive in India. A holder of a valid foreign driving licence may drive in India for up to 12 months. Beyond 12 months of residence in India, the person must obtain an Indian driving licence. International Driving Permits (IDP) issued under the 1968 Vienna Convention on Road Traffic are recognised in India. India is a signatory to the convention. In practice, tourists can drive with their home country's licence or IDP. Expatriates and long-term residents must convert their licence after 12 months — the process typically involves a test of traffic signs and sometimes a practical test, depending on the applicant's home country.
Historical Context
The recognition of foreign driving licences reflects India's international obligations under the Vienna Convention on Road Traffic and the practical need to facilitate tourism and business travel.Critical Changes
DigiLocker/digital IDP format accepted at par with physical IDP.
12-month maximum for foreign licence use without conversion — unchanged.
Practical Scenarios
"A German tourist visiting India for 2 months — can drive on their German licence for the full stay."
"A US national who has lived in India for 18 months — must have an Indian licence; US licence no longer valid."
